Legal position.

According to law. The builders are suppose to pay 1% of the price for every months delay as a compensation/penalty. Those using lawyers can have this confirmed.

Hi Guys
If Shaq's info is correct does anyone know what the delay was on AP1 ?
I have had contact now saying the apartment is ready and the water leaking problems have been fixed. They are asking me to complete now.

Just returned from Alcudia. Was expecting my apartment to be ready as they had said. Not the case, not sure why they told me to come and complete. Waste of my time and money. Not much work going on, doubt if anything will get done now. All work stops soon for summer period and then its ramadan. with celebrations going on for weeks work won't start again til october.
Did anyone else have the same experience?
No point completing now, you will be paying the mortgage but will not be able to rent it out this year. Next summer is the soonest.
AP1 AS STILL A BUILDING SITE. NO BINS FOR RUBBISH. NO RUBBISH COLLECTIONS. HOW CAN YOU LIVE THERE?

I just heard that the completion dates for AP4 and AP5 have been put back again. beginning to look like end of year.
The following are to blame:
the weather (that's an act of God),
Ramadan (God again!),
and the King (as close to being a Deity as is humanly possible).

Important to realise that under NO circumstances are Fadesa or Addoha culpable.
Those gods sure have a lot to answer for!...and I don't think they can be sued for breach of contract either!!!

Hi Guys - silly question time

Say I paid about £55,000 for my apartment and it was delayed by about 20 months . Based on a 1% per month delay cost incurred by the developer - any idea how much I should be entitled to from the developer.

1% for every month as per law makes it 20%. you tan take the 20% of
£ 55,k = £11 k,. So you property should cost you £44k in theory.

Dont expect that Adoha is just going to lie down & surrender. You need to use a lawyer for them to be forced.
